Downstream is a training platform for indoor rowing — a mobile app, the website at rowdownstream.app, and the services behind them (together, the "Service") — operated by Row Downstream LLC, a Virginia limited liability company ("Downstream," "we," "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
The Service is currently in beta: features change, break, and occasionally disappear while we build.
You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to enter these Terms yourself — under 18, a parent or guardian must agree on your behalf and supervise your use. You're responsible for your account credentials and for everything done under your account.
Read this section carefully. It is the most important part of these Terms.
Downstream is not medical advice, and it is not a coach. Workouts, training plans, target paces, training zones, heart-rate figures, "load" scores, and every other number or suggestion in the Service are informational tools. They are not medical advice, physical-therapy advice, or a prescription, and they are not tailored to your health. Consult a physician before beginning this or any exercise program — especially if you are over 35, pregnant, or have (or suspect) any medical condition, including heart, lung, joint, or blood pressure conditions.
Every workout is optional, and every number is a suggestion. Nothing in the Service requires you to perform any workout, hold any pace, or complete any plan. You alone decide whether to start, how hard to go, and when to stop — and you can always slow down, skip, or quit a piece. If a target feels wrong for your body on a given day, it is.
Stop immediately and seek medical attention if you experience chest pain, faintness, dizziness, unusual shortness of breath, nausea, or sharp or persistent pain while exercising. Do not use the Service while impaired.
Your equipment is your responsibility. Downstream is software. We do not manufacture, inspect, or maintain your rowing machine or any other equipment, and we are not responsible for its condition, setup, or your technique on it.
You acknowledge that athletic activity — including indoor rowing — carries inherent and significant risks of property damage, bodily injury, and death. By using the Service you voluntarily and knowingly assume all such risks, both known and unknown, even if caused in whole or in part by the acts, omissions, or negligence of Downstream or others, to the fullest extent permitted by law. You expressly release Row Downstream LLC, its members, officers, employees, contractors, agents, and licensors from any and all liability connected with your athletic activities, and you covenant not to sue them for any such claim. Where applicable law does not permit the exclusion of certain liability, that liability is limited to the greatest extent permitted.
The Service lets coaches and teammates share workouts, plans, and assignments. That content is user content: coaches on Downstream are not our employees or agents, we do not vet, certify, or supervise them, and a workout assigned by a coach is still — as in Section 3 — a suggestion you alone decide whether and how to perform. Coaches are responsible for the content they assign and for having the right to work with their athletes.
The Downstream mobile app is free, including workout capture, sync, and Concept2 Logbook upload. Premium web features ("Pro") require a paid subscription. Prices are shown at purchase and may change with notice effective at your next renewal. Subscriptions renew automatically until cancelled; cancelling stops the next renewal and Pro remains active through the period already paid. Except where the law requires otherwise, payments are non-refundable. During the beta we may enable Pro features for testers at no charge and may end that access at any time.
Your workouts are yours. You grant us the license we need to host, process, sync, and display your data to operate the Service — including to teammates and coaches exactly as your team settings allow, and to third-party services (such as the Concept2 Logbook) when you connect them. Disconnecting an integration stops future sharing to it. Our Privacy Policy describes what we collect and how we handle it.
The Service works with third-party products and services — Concept2 monitors and the Concept2 Logbook, Google sign-in, Bluetooth heart-rate devices, and others. Their terms govern your use of them, and we're not responsible for them. Concept2, RowErg, and PM5 are trademarks of Concept2, Inc. Downstream is an independent product, not affiliated with or endorsed by Concept2, Inc.
The Service — software, design, brand, and content we created — belongs to Row Downstream LLC and its licensors. These Terms don't transfer any of it to you beyond the personal, non-transferable right to use the Service. If you send us feedback, we may use it without obligation.
The Service is provided "as is" and "as available," with all faults and without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any metric — including pace, watts, distance, heart rate, training load, or zone estimates — is accurate or fit for any purpose. Data displayed from your monitor or sensors is theirs; analytics derived from it are estimates.
To the fullest extent permitted by law, Row Downstream LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to the Service, regardless of the theory of liability. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim arose or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations; in those jurisdictions these limits apply to the fullest extent permitted.
You agree to defend and indemnify Row Downstream LLC and its members, officers, employees, and agents against claims and costs (including reasonable attorneys' fees) arising from your use of the Service, your content, your athletic activities, or your breach of these Terms.
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or create risk for the Service or others. Sections 3 and 9–15 survive termination.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflicts of law. Before filing any claim, you agree to contact us and give us thirty days to try to resolve it informally. Any dispute that isn't resolved informally will be brought exclusively in the state or federal courts serving Chesterfield County, Virginia, and you consent to their jurisdiction. Both sides waive any right to a class action; disputes may be brought only individually.
We may update these Terms; material changes will be announced in the app or by email, and continued use after the effective date is acceptance. If you got the app through Apple's App Store or Google Play, their terms also apply to the download itself, and Apple and Google are third-party beneficiaries of this section solely to the extent their policies require.
